Terms and Conditions
Subscription Plans: The seller offers three premium packages for the WhatsApp chatbot, priced at $4.50, $10.50, and $15 USD per month. Subscriptions are automatically recurring until cancelled by the user.
Payment Processing: Payment for the subscription plans is handled through the online service Stripe, which has its own terms and conditions for payment processing. The seller does not store or process any payment information and is not responsible for any issues related to payment processing through Stripe.
Automatic Renewal: Subscriptions will be automatically renewed at the end of each billing cycle, unless cancelled by the user. Users are responsible for cancelling their subscriptions before the next billing cycle if they wish to terminate the subscription.
Usage Restrictions: Users agree that the WhatsApp chatbot provided by the seller shall not be used for any illegal activities, including but not limited to activities involving profanity, pornography, or any activities that violate the policies of OpenAI or any applicable laws or regulations. Users also agree not to engage in any activities that may cause harm, damage, or disruption to the chatbot or its users.
Intellectual Property: The seller does not claim ownership of any trademarks, copyrights, or any other intellectual property associated with the WhatsApp chatbot. Users shall not reproduce, distribute, or modify any content of the chatbot without obtaining prior written consent from the seller. Users also agree not to reverse engineer, decompile, or disassemble the chatbot or attempt to gain unauthorized access to its source code or proprietary information.
Data Collection and Privacy: The seller collects and uses user data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR) and the seller's data policy. Users can review the data policy section for detailed information on the types of data collected, purpose of data collection, and how the data is used and protected. Users also have the right to request access, correction, or deletion of their personal data as permitted by law.
Liability and Disclaimers: The seller provides the WhatsApp chatbot "as is" and does not make any warranties or representations regarding the accuracy, reliability, or availability of the chatbot. The seller shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use or inability to use the chatbot or any content provided by the chatbot. Users acknowledge and agree that the use of the chatbot is at their own risk, and the seller does not guarantee the accuracy, completeness, or reliability of any information or responses provided by the chatbot.
Termination: Users can terminate their subscription at any time by cancelling through the appropriate channels, as specified by the seller. Upon termination, access to the chatbot will be restricted, and no refunds will be provided for any unused portion of the subscription fees. The seller also reserves the right to terminate or suspend a user's subscription or access to the chatbot at any time, without notice, for any violation of these terms and conditions or for any other reason deemed necessary by the seller.
Governing Law and Jurisdiction: These terms and conditions shall be governed by and interpreted in accordance with the laws of Switzerland, without regard to its conflicts of law provisions. Any disputes arising from or in connection with these terms and conditions shall be exclusively resolved by the courts of Switzerland.
Miscellaneous: Any additional terms and conditions relevant to the subscription plans or the usage of the WhatsApp chatbot may be included in this section, such as force majeure clauses, dispute resolution procedures, or other provisions as deemed necessary by the seller.
